The decision by High Court judge James Aboud to deny the request for a conservatory order stopping construction work on the disputed Debe to Mon Desir segment of the Point Fortin highway project is an important denouement in the two-year struggle by the Highway Reroute Movement (HRM) to effect a substantial change in the path of the highway.
It's notable that Justice Aboud made it clear that the movement had a strong case and that Prime Minister Kamla Persad-Bissessar and her Cabinet had given the group assurances pursuant to their discussions that amounted to a legitimate expectation.
The judge further noted that his ruling last week "might not have any bearing on his future judgement on the substantive issues of the case." That might seem to offer hope that there might be some silver lining to be found in the rather cloudy situation that the movement finds itself in, but the prevailing tone of the judgement suggests that the efforts being made through the courts will ultimately amount to far too little pursued much too late.
