I hold no briefs for Steve Ferguson and/or Ish Galbaransingh. It is my view that if someone, whoever he/she may be, does the crime they should pay the time. But my limited legal knowledge informs me they are entitled to bail regardless of whether "anything new" has come up regarding their case. They are being held for a bailable offence.
The men were on bail for years and were only taken into custody when it was determined by the respected Attorney General that they would be imminently extradited to Miami to face US imposed charges. At the time, it was determined that the duo had exhausted all their legal appeals and would be sent to the US.
As it turned out, the Appeal Court has ruled the extradition process was flawed and that a lower court did not make a proper review of the AG's decision to authorise their extradition. Now that the extradition process is going to be reviewed, it is only fair that the status quo, ante the AG's decision, be returned, allowing the men to remain on bail. They are not flight risks. The judge erred in not granting bail.
