A 28-year-old Vistabella painter suspected of being in possession of a gun was denied bail yesterday. Phil Joseph appeared before Magistrate Siemungal Ramsaran in the San Fernando Second Court charged with possession of a firearm. Police claim he was held with the gun on Jarvis Street Vistabella on October 21. He was not called upon to plead to the indictable charge. In applying for bail, his attorney Subhas Panday, said Joseph was gainfully employed and a father of two.
Panday said his client had no previous convictions, but one pending matter for robbery. However, court prosecutor Dianath Harricharan objected to bail on the grounds of the gravity of the offence and the prevalence of such weapons. Harricharan also indicated that the police did not have the chance to trace Joseph to determine whether he had previous convictions or pending matters. The magistrate denied bail remanding him in custody for tracing. He advised Joseph of his right to apply to a Judge in Chambers for bail. The matter was adjourned to October 31.
