Three months after a Port-of-Spain man appeared in court charged with threatening to kill the Prime Minister, a state attorney is yet to be appointed to prosecute the matter. Recalled for a fourth time yesterday, the matter was unable to proceed after Sgt Ricky Lochan told Chief Magistrate Marcia Ayers-Caesar the file was yet to be sent to Director of Public Prosecutions Roger Gaspard.
The charge against Nicolai Marfan, 23, of Charford Court, Charlotte Street, Port-of-Spain, is that on October 10 at the Western Main Road he is alleged to have sent a message by telephone which was menacing in character. Marfan, an airport employee, allegedly telephoned the police, threatening to kill Prime Minister Kamla Persad-Bissessar. He was arrested at Piarco Airport on October 12 by ASP Ajith Persad and Cpl Anthony Williams of the Port-of-Spain CID.
Marfan pleaded not guilty during his first court appearance on October 15. He was granted $75,000 with a surety to be approved by a clerk of the peace. His attorney later presented an application for reduced bail to a judge in chambers and Marfan was granted $5,000 own bail.
Confirming he had been reporting to the Besson Street Police Station three times weekly, Lochan asked for a long adjournment to ensure a prosecutor was appointed by the next adjourned date. Marfan, who is represented by attorney Joseph SD Sookhoo, will reappear on March 19.
