There was a breach of duty of care by both Paria and LMCS.
Counsel to the Commission, SC Ramesh Lawrence in his findings in the enquiry says both companies had a responsibility to ensure safety measures were in place for such a high-risk job.
He adds that LMCS failed to acknowledge the possibility of a Delta P hazard occurring on the job site, while Paria failed to identify this risk was missing due to a lack of expertise.
Since the Delta P hazard was not accounted for, neither company were equipped to deal with the tragedy that claimed the lives of four divers on February 25, 2022.
Maharaj said the commission intends to present a final report of the findings of the enquiry to the president by April 30, 2022.
He says this is one of the fastest a report has been produced by a commission within the commonwealth.
