A T&T na­tion­al who was aboard the Venezue­lan boat in­volved in an in­ci­dent with the T&T Coast Guard where a ten-month-old ba­by boy was shot in the head and killed ear­li­er this month, was re­leased by au­thor­i­ties on Fri­day night af­ter his moth­er re­tained at­tor­neys to file a writ of Habeas Cor­pus on his be­half.

An­dre Daniel, 32, a con­struc­tion work­er and fish­er­man of Mar­rie Road, Mor­vant, was re­leased on Fri­day.

His re­lease came 13 days af­ter the boat’s pas­sen­gers were de­tained by the coast guard at the He­li­port, Ch­aguara­mas.

At­tor­ney Kyle Lawrence Cox ap­peared be­fore Jus­tice Na­dia Kan­ga­loo in the High Court, where he suc­cess­ful­ly ar­gued that Daniel had not been charged with any crim­i­nal of­fence.

In the ap­pli­ca­tion which cit­ed his con­tin­ued de­ten­tion as il­le­gal and un­law­ful, Cox said Daniel’s “Con­sti­tu­tion­al rights, in­ter alia the right to lib­er­ty, equal­i­ty be­fore the law and pro­tec­tion of the law, re­spect for pri­vate life, free­dom of move­ment, the right not to be sub­ject­ed to ar­bi­trary de­ten­tion or to im­pose or au­tho­rise the im­po­si­tion of cru­el and un­usu­al treat­ment or pun­ish­ment,” had been vi­o­lat­ed.

The Venezue­lan in­fant, Yaelvis San­toyo Sara­bia, who was killed on Feb­ru­ary 6, was on­ly laid to rest on Fri­day.

Sara­bia’s moth­er, who was shot in the shoul­der dur­ing the same in­ci­dent, was un­able to at­tend the fu­ner­al af­ter she was tak­en in­to cus­tody by po­lice of­fi­cers on Fri­day.
